Subject and application of the following terms and conditions
These terms and conditions govern the relationship between the Comitato Arte & Cultura Binningen-Bottmingen and the artist. The Comitato Arte & Cultura Binningen-Bottmingen will appoint an organizing committee (hereafter the OC) to organize and conduct the exhibition Arte-Binningen. Decisions made by the OC are final and there is no appeal possible. These terms and conditions constitute part of the agreement between the OC and the artist.

Exhibition space
Every participant will be allocated an exhibition space of 4 meters (for paintings or photographs) or 2 tables (for sculptures) respectively. Paintings have to be framed neatly and must not be hung one upon the other (exceptions may be approved by the OC). It is allowed to leave the painting unframed if the margins are painted white. For participants with sculptures this rule shall be applied correspondingly.

Participation fees
The participation fee for Arte-Binningen is CHF 300.00 or € 200.00 respectively.

Payment details
Upon receipt of the confirmation of participation the participation fee shall be transferred 4 weeks prior to the start of the exhibition at the latest. Payment shall be made by bank transfer to the account of Arte-Binningen stated below. No additional invoice will be sent.

Prices
The prices of the exhibits shall be indicated in CHF (Swiss Francs) only, excluding VAT.

Sales
The organizer charges 20% of the selling price of each sold object as commission. For the duration of the exhibition only the OC has the right to issue purchase contracts. Every sold object will be marked with a red dot and stays in the exhibition until the closing event. (Exceptions to this rule may be approved by the OC.) Reserved objects will be marked with a green dot. (Reservations will generally be upheld for two days.) The transfer of the commission fee to the organizer is based upon good faith. The organizer has the right to charge a commission even for objects sold after the exhibition. This applies to all objects sold within 9 months after the exhibition. A pay in slip will be included in the exhibition documentation. On this the number of sold objects, the selling price and the resulting commission need to be stated.

Liability
The personal liability of members of the OC is excluded. The OC assumes no liability for any kind of damage (e.g. theft, fire, etc.). It is the participant’s responsibility to take out insurance.

Privacy
The data of artists and sponsors are exclusively used for Arte-Binningen. These data will only be passed on to third parties after the company / person in question has given their express consent. The data of donors are only used for invoicing purposes and sending of the newsletter.


Cancellation
In case of cancellation the following rules apply: Three to four months prior to the opening of the exhibition 60% of the fees will be refunded. Less than three months prior to the opening of the exhibition no fees will be refunded. The participation fee shall forfeit for the benefit of Arte-Binningen.

Jurisdiction
All obligations are subject to Swiss law. Place of performance and only place of jurisdiction is Binningen.

IMPORTANT: In case of dispute or doubt the German version of these terms and conditions prevail. Only the German terms and conditions are legally binding.
